Anne Studd QC appears for Greater Manchester Police in application for writ of Habeus Corpus brought by Mathew Owens who was required to quarantine in a hotel under The Health Protection (Coronavirus, International Travel) (England) Regulations 2020/568 as amended having transited through Abu Dhabi.
The Claimant, Mathew Owens arrived at Manchester airport from Bahrain via Abu Dhabi and Frankfurt. Abu Dhabi being one of the United Arab Emirates is a red list country and transit through a red list country requires 10 days of quarantine in a managed quarantine hotel. Mr Owens refused to go to the hotel and having been taken there, refused to check in and was picked up by his family from the hotel and taken to his home in Liverpool. He was subsequently arrested by Merseyside officers and returned to the hotel in Birmingham. He applied for a writ of habeas corpus claiming that his “detention” was unlawful.
The application was dismissed with costs.
