Alastair Hodge acts for employer in historic and landmark case in the Jersey Employment Tribunal on the meaning of “disability” in paragraph 8(2) of Schedule 1 of the Discrimination (Jersey) Law 2013.

The concept of disability discrimination was only introduced into Jersey law in 2018. The majority of claims since then have either settled or been withdrawn.

This is the first time that the Tribunal has had to rule on the definition of disability, which differs significantly from the definition contained in the Equality Act 2010. 

Judgment is awaited.
