The litigation came about as a result of the Defendant being wrongly and according to Hallett LJ ‘catastrophically’ granted an “on the run” letter as part of the Northern Ireland peace process. The criminal case against him was stayed at the Old Bailey in 2014 and the family sought to bring a vindicatory claim against the Defendant in the civil courts. Mrs Justice Yip disapplied the primary limitation period under section 33 Limitation Act 1980 and found that on the evidence and in particular the fingerprint evidence that had been reexamined for the purposes of the civil claim, the Defendant John Downey was part of a common design to commit a premeditated act of murder.
Assessment of damages to be heard next year.
