Jason Beer QC, Alan Payne and Cicely Hayward in new Court of Appeal decision on immunity from suit
Today the Court of Appeal handed down its judgment in Daniels & Others v Chief Constable of South Wales Police EWCA Civ 680. The Court of Appeal decided that “the core immunity” that protects certain participants in legal proceedings from suit in relation to aspects of their conduct was in essence a witness immunity and did not necessarily extend to protect police officers’ conduct in giving disclosure, by MG6 schedules, in criminal proceedings.
The full judgment may be read here.
